Article 4 Directions.

People that live in most houses or bungalows (not flats) have the right to make certain types of minor changes to their home without the need for planning permission (although some properties may have had these rights removed individually for various reasons). These rights are called 'Permitted Development Rights'.  Permitted development rights can be taken away under Article 4 of the Town and Country Planning (General Permitted Development) Order 1995, as amended. The removal of permitted development rights means that planning permission must be sought before alterations can be made or works carried out. There is no fee for planning applications which would be permitted development had the Article 4 Direction not been made.  Article 4 Directions are usually implemented in sensitive areas where changes could be particularly damaging to the character and appearance of an area.  The following conservation areas have Article 4 Directions in place: 

❖ Heath, Wakefield
❖ St Johns, Wakefield 
❖ Whitwood Terrace, Castleford

Prior to commencing with development within these conservation areas it is advised that you contact the Conservation Team to clarify whether these controls impact upon the proposed works (01924) 306586.

Designated: 14th March 1972  

Article 4 direction controlling the following development:  

1. The enlargement, improvement or other alteration of a dwelling house.  

Up to 50 cubic metres or one-tenth the cubic content of the original house. Extensions above this limit are already covered by normal planning controls.  

All garages, stable looseboxes and coach-houses are also covered by Article controls, although small outbuildings such as greenhouses and garden huts are not included.  

2. The erection or construction of any gates, fences, walls or other means of enclosure, and their maintenance, improvement or any other alteration. This does not include hedges.  NB: Walls and fences above 1 metre where next to a highway and above 2 metres anywhere else are already covered by normal planning controls.
